Drone Pilots Could Be Tried for ‘War Crimes,’ Law Prof Says [04/29/10] "The pilots waging America’s undeclared drone war in Pakistan could be liable to criminal prosecution for “war crimes,” a prominent law professor told a Congressional panel Wednesday.  Harold Koh, the State Department’s top legal adviser, outlined the administration’s legal case for the robotic attacks last month. Now, some legal experts are taking turns to punch holes in Koh’s argument. It’s part of an ongoing legal debate about the CIA and U.S. military’s lethal drone operations, which have escalated in recent months — and which have received some technological upgrades. Critics of the program, including the American Civil Liberties Union, have argued that the campaign amounts to a program of targeted killing that may violate the laws of war. In a hearing Wednesday before the House Committee on Oversight and Government Reform’s national security and foreign affairs panel, several professors of national security law seemed open to that argument. But there are still plenty of caveats, and the risks to U.S. drone operators are at this point theoretical: Unless a judge in, say, Pakistan, wanted to issue a warrant, it doesn’t seem likely. But that’s just one of the possible legal hazards of robotic warfare. Loyola Law School professor David Glazier, a former Navy surface warfare officer, said the pilots operating the drones from afar could — in theory — be hauled into court in the countries where the attacks occur. That’s because the CIA’s drone pilots aren’t combatants in a legal sense. “It is my opinion, as well as that of most other law-of-war scholars I know, that those who participate in hostilities without the combatant’s privilege do not violate the law of war by doing so, they simply gain no immunity from domestic laws,” he said. “Under this view CIA drone pilots are liable to prosecution under the law of any jurisdiction where attacks occur for any injuries, deaths or property damage they cause,” Glazier continued. “But under the legal theories adopted by our government in prosecuting Guantánamo detainees, these CIA officers as well as any higher-level government officials who have authorized or directed their attacks are committing war crimes.” ..."

FBI agent short on details on militia inquiry [04/28/10] "An FBI agent who led the investigation of nine Michigan militia members charged with "trying to launch war against the federal government" couldn't recall many details of the two-year probe yesterday during questioning by defense lawyers.  Even the judge who must decide whether to release the nine until trial was puzzled...."  Note:  The conspiracy-obsessed federal government is trying to keep in a cage the nine Michigan “militia” taxpayers its agents provocateur persuaded to say dumb things. At least that was the official story, as reported in the official media. The nine were going to overthrow the government using the government’s signature tactics of force and violence. Really. Truly. Nine working-class people vs. the greatest military empire in history and its millions of troops and cops and spies. Of course, the whole thing was a set up by the Obama police state, which may even be worse than the Bush police state. But now it looks as if the feds may have made everything up. Feds Try to Link Gun Dealer to Hutaree "The ATF is attempting to link a Michigan gun dealer to the Hutaree “militia,” the group charged with plotting to kill local police.  ..."  

The Mystery of Poland's Presidential Plane Crash Deepens [04/28/10] "According to an anonymous source, the investigation into the causes of the Polish presidential plane crash may be subjected to political pressure which could hinder the ongoing investigation. This, claims the source, is due to the political aspect of the accident: the tragic death of the president on the territory of a foreign country.  The Polish presidential jet was not insured, which could mean that the party at fault in the tragedy may be subject to a multimillion dollar civil litigation suit by families of the victims. This situation additionally complicates the fact that the Polish president was headed to Russia to commemorate a mass murder of Polish officers during World War II by the Soviets in Katyn, "a cursed place" as the former President of Poland Aleksander Kwasniewski has described it. Because the catstrophe occurred on Russian territory, Polish investigators have no right to conduct their own inquiry under current laws, it has emerged. According to Polskaweb, Seremet is flying to Moscow to try to clarify questions specifically concerning ..."

Clinton: 'Iran doesn’t directly threaten the United States' [04/27/10] "Secretary of State Hillary Clinton said publicly that Iran “doesn’t directly threaten the United States.” Her momentary lapse came while answering a question at the U.S.-Islamic World Forum in Doha, Qatar, on Feb. 14. ...In a rambling comment, Clinton had lamented that, despite President Barack Obama’s reaching out to the Iranian leaders, he had elicited no sign they were willing to engage: “Part of the goal — not the only goal, but part of the goal — that we were pursuing was to try to influence the Iranian decision regarding whether or not to pursue a nuclear weapon. And, as I said in my speech, you know, the evidence is accumulating that that [pursuing a nuclear weapon] is exactly what they are trying to do, which is deeply concerning, because it doesn’t directly threaten the United States, but it directly threatens a lot of our friends, allies, and partners here in this region and beyond.” How often have we heard the Israelis say they would consider nuclear weapons in Iran’s hands an “existential” threat? But let’s try a reality check.  Former French President Jacques Chirac is perhaps the best-known statesman to hold up to ridicule the notion that Israel, with between 200 and 300 nuclear weapons in its arsenal, would consider Iran’s possession of a nuclear bomb an existential threat. In a recorded interview with the New York Times, the International Herald Tribune, and Le Nouvel Observateur, on Jan. 29, 2007, Chirac put it this way: “Where will it drop it, this bomb? On Israel?” Chirac asked. “It would not have gone 200 meters into the atmosphere before Tehran would be razed.” Thus, Iran’s possession of a nuclear bomb would not be “very dangerous.”  

Bush adviser’s PR firm running defense for West Virginia coal mine [04/27/10] "The company that runs the West Virginia coal mine where 29 workers died earlier this month has hired a PR firm run by a former top adviser to President George W. Bush to help fend off bad publicity in the wake of the disaster.  With some groups calling for the arrest of Massey CEO Don Blankenship, and a shareholders' revolt brewing over the April 5 disaster, Massey Energy has turned to Austin, Texas-based Public Strategies Inc. for advice on how to handle the firestorm of criticism. The company's president and CEO is Dan Bartlett, a veteran of President Bush's communications team who was linked to efforts to expose the identity of CIA agent Valerie Plame in the Plamegate affair. Public Strategies' hiring was first reported by the Wall Street Journal last week, and flagged by Zachary Roth at TalkingPointsMemo. The PR firm "has been brought in by the mining company’s board in recent days to advise it on how to respond to questions about the company’s governance and the board’s general oversight of the company," the WSJ reported. The newspaper describes the PR firm as being "politically connected." On its Web site, the company indicates that it uses public opinion pressure and "grassroots marketing" operations to promote the political agendas of its clients. ..."

Ohio man, Joseph Sean McVey, arrested as Obama leaves NC  [04/27/10] "An armed man who was spotted at a North Carolina airport parking lot just after Air Force One departed and said he wanted to see the president was to appear before a judge Monday.  Authorities arrested Joseph Sean McVey, 23, of Coshocton, Ohio, on Sunday afternoon at the Asheville Regional Airport and charged him with going armed in terror of the public, a misdemeanor. A first appearance in court was scheduled for Monday, said Sgt. John Lutz of the Buncombe County jail, where McVey was being held on $100,000 bond. McVey told an officer in the airport parking lot he wanted to see the president and he had a car equipped with police gear, including a siren and flashing lights, though he did not work in law enforcement, authorities said. ..."  Note:  Mcvey? .... interesting how this guy bears a name that sounds like McVeigh .. who was charged in the Oklahoma incident, and it happens right after the anniversary that was played up so highly by the cultural media. Clinton Advisor: Reno Threatened To "Tell The Truth About Waco" If Not Reappointed To Office [04/26/10] "A close advisor to Bill Clinton during his White House tenure dropped a bombshell this week on the seventeenth anniversary of the Waco siege.  Dick Morris, a longtime friend of Clinton and political advisor during his first term in office, told Sean Hannity that the President was not going to appoint Attorney General Janet Reno to a second term in office following the federal barrage on the Branch Davidian ranch at Mount Carmel. "Bill Clinton orchestrated that takeover and in fact was so ashamed of what he did in Waco that he was not going to appoint Janet Reno to a second four year term" Morris stated. "She told him in a meeting right before the inauguration day for his new term, that 'if you don't appoint me, I'm gonna tell the truth about Waco' and that forced Clinton's hand in reappointing her." Suicide rate among war veterans is extraordinary, new data reveals [04/26/10] "Thirty try to commit suicide each day, on average, reports the Army Times. Eighteen succeed, roughly five of whom receive medical care from Veterans Affairs, rated one of the best health programs in the country.  “Of the more than 30,000 suicides in this country each year, fully 20 percent of them are acts by veterans,” said VA Secretary Eric Shinseki at a VA-sponsored suicide prevention conference in January, Inter Press Service reported. UK Algerian pilot wrongly accused of 'training 9/11 hijackers' is in line for £2m payout from Britain [04/25/10] "The pilot falsely accused of training the hijackers responsible for the 9/11 terrorist attacks has won his almost decade-long miscarriage of justice battle.  Lotfi Raissi, an Algerian living in Britain who lost his career as an airline pilot, suffered wrongful imprisonment and damage to his health, will now be eligible for up to £2m compensation.  Raissi became the first person to be accused of participating in the 2001 attack in New York and Washington. He was held for five months in Belmarsh high security prison in London and told he would be charged with conspiracy and murder in the US where he could face the death penalty. ..."

Israel: 'Iranian nuke scientist seeks asylum in Israel' [04/25/10] "A senior Iranian nuclear scientist sought political asylum in Israel, Deputy Minister Ayoob Kara said Saturday. Kara refused to reveal the scientist's identity and exact role, and also the identity of the mediator who helped him contact Israeli authorities. Speaking at a panel in Ramat Gan, the deputy minister said the scientist is currently staying in a "friendly country" and that he turned to a Jewish former resident of Iran for assistance. The Jewish female turned to Kara himself, he said. Report: Netanyahu Open to Palestinian State With ‘Temporary Borders’ [04/25/10] "Israeli Prime Minister Benjamin Netanyahu has reportedly suggested that he would accept a Palestinian state with temporary borders as a conciliatory move to the Palestinian Authority.  But exactly how much of an “offer” this is remains to be seen. Judge Napolitano: Arizona Immigration law will ‘bankrupt the Republican Party’ [04/25/10] [0:56]  "...Hispanics -- who have a natural home in the Republican Party because they are socially conservative -- will flee in droves. She's also gonna bankrupt her state, because no insurance company will provide coverage for this. And for all the lawsuits that will happen -- for all the people that are wrongfully stopped -- her budget will be paying for it. Her budget will be paying the legal bills of the lawyers who sue on behalf of those that were stopped. This will be a disaster for Arizona -- to say nothing of the fact that it's so unconstitutional that I predict a federal judge will prevent Arizona from enforcing it as soon as they attempt to do so. That will probably be tomorrow.  The new law, which will take effect in late July or early August, was cheered by many, including Maricopa County Sheriff Joe Arpaio, whose tough crackdowns have made him a hero in the anti-illegal immigration community. He said it gives him new authority to detain undocumented migrants who aren't accused of committing any other crimes.  "Now if we show they're illegal, we can actually arrest them and put them in our jails," Arpaio said.  Critics claim the bill will effectively encourage racial profiling. President Barack Obama branded it "misguided." Hispanic groups across the country tend to agree with Napolitano's assessment of the bill. ..."

Triple Canopy, a private military company with extensive security operations in Iraq and Israel, is advertising for business in Haiti. According to human rights activist and investigative reporter Jeremy Scahill, Triple Canopy took over the Xe/Blackwater security contract in Iraq in 2009. McAfee False Detection Locks Up Windows XP [04/21/10] "McAfee’s anti-virus software is erroneously detecting legitimate Windows system files as malicious, causing reboot loops and serious stability problems for many Windows XP users, according to multiple reports. The SANS Internet Storm Center has received dozens of reports from McAfee users who complained that a recent anti-virus update (DAT 5958) is causing Windows xP Service Pack 3 clients to be locked out. According to SANS incident handler Johannes Ulllrich, McAfee is flagging “svchost.exe” as malicious. Svchost is a common system process typically used by multiple legitimate programs on a Windows system (although malware does often inject itself into this process), so having an anti-virus program that flags the process as a threat could cause major problems on a host system, Ullrich said. “The [reports] keep coming in,” Ullrich said. “Systems either get stuck in a reboot loop, or networking is no longer working.” One symptom seems to be that McAfee reports that user systems are infected with W32.Wecorl.a. Poland was to be one of the eastern European hosts of the US missile defense shield, a military action condemned by Russia and Mr. Putin.  While Polish President Kaczynski’s death may very well be an accident, as described by official reports from Russia, one must ask whether or not the Russians have settled a score with Poland and sent a warning to leaders of other nations in the region that Russia is in charge. The death of President Kaczynski comes on the heels of the overthrow of a pro-US government in Kyrgyzstan, which may have been initiated by operatives of the Russian government, similar to what the CIA did in Latin America and around the world to destabilize governments and replace them with leaders sympathetic to their national interests. Mr. Putin is a professional game theorist, thus Russia’s involvement in Kyrgyzstan cannot be ruled out ... "By virtue of finding what the Bush administration did to our clients was illegal, he found that the Terrorist Surveillance Program was unlawful," Eisenberg said.  President Bush authorized the surveillance program shortly after 9/11, allowing NSA officials to bypass the courts and intercept electronic communications believed connected to al-Qaida.  Generally, government investigators are required to obtain search warrants signed by judges to eavesdrop on domestic phone calls, e-mail traffic and other electronic communications.  At issue Wednesday was a 2006 lawsuit filed by the Ashland, Ore., branch of the Saudi-based foundation and two American lawyers Wendell Belew and Asim Ghafoor.  Belew and Ghafoor claimed their 2004 phone conversations with foundation official Soliman al-Buthi were wiretapped without warrants soon after the Treasury Department had declared the Oregon branch a supporter of terrorism. They argued that wiretaps installed without a judge's authorization are illegal. ..."

Govt. Wastes Millions To Keep Empty Buildings [04/01/10] "Among the decaying buildings is a huge, taxpayer-owned structure in the heart of Washington D.C., within view of the U.S. Capitol. Officially known as Federal Building Number 8, the property stretches an entire city block and is worth around $100 million but Uncle Sam is losing money because the building isn’t habitable and has been empty since 2002.  In Milwaukee Wisconsin, the government dishes out $348,000 a year to maintain a crumbling Veterans Administration complex located upon a sunny hilltop. In Maywood Illinois, not far from Chicago, taxpayers own a decrepit 58,000 square-foot Veterans Affairs complex that’s been empty for more than a decade and a half. In Kansas City a dead body was found in an abandoned courthouse not too long ago.  Most of the buildings are under the supervision of the General Services Administration, which is responsible for managing and preserving government buildings and leasing commercial real estate. The agency promotes itself as a prime example of excellence in the business of government and claims its policies promote efficient government operations.  Its inefficiency is nothing new however, and has been documented in various government audits in recent years. In fact, the investigative arm of Congress, the Government Accountability Office, published a scathing report a few years ago detailing the exorbitant cost maintaining 927 vacant or underutilized properties throughout the country. The facilities, according to the GAO report, represented about 32.1 million square feet and ranged from office buildings to hospitals and post offices.  ..."

Insurance Death Spiral, Here We Come [04/01/10] "When states tried to fix their individual health insurance markets—the marketplace for those who don't get insurance through their employers—the initial idea was to simply prohibit insurers from discriminating against individuals with preexisting conditions. The solution to this problem, both in Massachusetts and in ObamaCare, was the individual mandate: Force everyone to pay in, bringing balance to the insurance pool and keeping prices down.
